DEED
OF AGREEMENT FOR BUILDING MAINTENANCE CHARGES
THIS DEED
OF'AGREEMENT FOR BUILDING MAINTENANCE CHARGES is made on this the 1st
day of July, 2015 of the Christian Era.
BETWEEN
MR KAZI ABDUS SALAM, S/O-
Late Kazi Mozaffar Hossain and Zulfia Salam of Eastern Harmony, Flat No- B/501,
House No- 11/B, Road No- 71, Gulshan, Dhaka, herein after called the land lord
(Which expression shall include this heirs, legal representatives, executors
and administrators) of The One Part.
AND
MR KAZI ABDUS SALAM, Managing
Director, M/S. Colour Quest Ltd, of Hossain Tower, 10th Floor ,
Suite No- 1001, 116 Gazi Golam Dastgir Road, (Box Culvert Road) Naya Paltan,
Dhaka- 1000 hereinafter referred to as the Tenant (Which expression shall
include this heirs, legal representatives, executors and administrators) of The
Other Part.
WHEREAS
THE LANDLORD is the owner and holds and possesses a plot with building thereon
mentioned in the Schedule-A at Husain Chamber, 7t" floor
(Southern side), Hossain Tower, 10th
Floor , Suite No- 1001, 116 Gazi Golam Dastgir Road, (Box Culvert Road) Naya
Paltan, Dhaka- 1000.
AND
WHEREAS THE LANDLORD has agreed to lease to the TENANT the 10th Floor
(Western portion) of Hossain
Tower, 10th Floor , Suite No- 1001, 116 Gazi Golam Dastgir Road,
(Box Culvert Road) Naya Paltan, Dhaka- 1000. measuring 1100
(One thousand One hundred) Sq.ft. hereinafter
called the demised premises monthly building maintenance charge @ Tk. 30.00 (Taka
Thirty) only per sq.ft. amounting to Tk. 33,000.00 (Thirty Three
Thousand) only per month and totaling yearly payment for Tk. 3,96,000.00 (Three Lac Ninety Six
Thousnd) only which advance will be
adjusted fully from the monthly building maintenance charges and the
TENANT has agreed to accept and pay the said building maintenance charges to the LANDLORD and the said parties hereto have
agreed to the terms and conditions set forth hereunder.-
NOW, THEREFORE, IT IS HEREBY AGREED BY
THE PARTIES AS FOLLOWS:
1. This deed of
agreement for building maintenance charges will be for 03 (Three) years with
effect from the 1st July, 2015 to the 30th June, 2018.
2. The TENANT shall pay to
the LANDLORD in advance an amount of Tk. 3,96,000.00
(Three Lac Ninety Six Thousnd) only at the time of signing this agreement as
building maintenance charges being chargeable with effect
from the 01st July 2015 which will be for the full period of
agreement subject to reference to the clause No. 4 of the Deed of Tenancy
Agreement and the advance will be adjusted against the monthly maintenance
charges.
3. If
the TENANT decides to continue the agreement at the end of each year of the
TENANCY then the TENANT shall have to enhance the
monthly rate of the building maintenance charges Q 10% on the fast year rate of the building
maintenance charges.
4. This Agreement for building maintenance charges will run
simultaneously with the Deed of Tenancy Agreement for the tenancy
of the demised premises and shall stand renewable or determinable with the said Deed as and when such
renewal or termination takes place on expiry of the tenancy period or by mutual consent.
5. Building
maintenance charges shall-cover payment for the following services to be
rendered by the lessor or their authorized agent:
a. Security service of common facilities only and
not of insideareas or demised premises.
b. General maintenance of common areas &
facilities only. The LANDLORD will keep such common areas and facilities clean
and well fit at all times.
c.
Utility (For lift
operator, electricity consumption for lift, oil consumption for generator,
salary for security guards and supervisor) cost is included with building
maintenance cost.
6. That all the terms and conditions agreed above
and also in the Deed of Tenancy Agreement executed separately on the same day
shall remain binding upon-the parties parallel during the tenure of both the
Deeds.
IN
WITNESSES whereof the parties hereto have set forth and subscribed their
respective hands on the date first
above-mentioned.
This Deed of Agreement contains on two pages & executed in
duplicate, both original, one for the LANDLORD & other for the TENANT.
