CONSTITUTION
Article No. 01(One) : Name of the Organization : Nirjatito
Manob Seba Kendra (CRTS) in Bengali.
"CENTRE FOR REHABILITATION OF TORTURE SURVIVORS
(CRTS)".
Article No. 02 (Two) : Address of the Organization : House No. 29, Road No. 8, Dhanmondi, Dhaka.
Article No. 03 (Three) : Working area of
the Organization : Dhaka District (In later period by the approval of the authority, there could
be made extension of the activity in whole over of Bangladesh).
Article No. 04 (Four) : Financial year of
the Organization : From 1st July to 30th June (In need)
from 1st January to 31st December.
Article No. 05 (Five) : Aims and Objectives of the Organization : "CENTRE FOR
REHABILITATION OF TORTURE SURVIVORS (CRTS)" is mainly a non-political
voluntary social welfare organization. As per of the demands to the general
peoples, this organization will be adopted of the real characteristic steps and
will be implemented of it.
a) To
make identification and collection of necessary information for all the
tortured peoples including the women, child and labour dependants.
b) To provide physical and
mental treatment to the tortured peoples.
c) To
arrange for the rehabilitation to the tortured peoples
and the members of his/her family in the
field of mental, physical and social.
d) To
make identification and to assist for remedy and resistance to the reaction
about public health and social affect due to torture.
e) To
conduct the programs like seminar, workshop and other research activities in
overall reaction to torture.
f) To
adopt the endeavor of the physical and mental treatment arrangement observation
evaluation and is development in need of the prisoners.
Seven)
To make communication and to make
co-ordination with different hospital or medical center or management center
about the treatment and rehabilitation of the organization.
Eight)
To make communication, exchange of
opinion and to make of co-ordination with different national and international
human right professionals and social, political organizations to the
development of the programs for the organization. Contd. P/2
i) To
make awareness to all level peoples of the society, including the professionals
in against of the torture.
j) To
set up education center and to arrangement of rehabilitation program to the
child, aged and disabled persons for to remove of the illiterates and for life
based education
Article No- 06 (Six) : classification of the membership post
such as :
(a) General Member
(b) Life Member
(c) Patron Member
General Membership post:
1. Person/persons
those who are confident to the principles and constitution of the organization
and after paid the fixed monthly contribution and admission fee and as per the
approval of the executive council, the membership post could be achieved.
Life Members:
Under the area of this organization any solvency social welfare person
having good characteristics person/persons will be made of contribution Tk.
15,000/- (fifteen thousand) Taka or equal of it as property or wealth to the
name of the organization and as per the approval of the executive council, the
life membership post could be achieved.
Patron Member:
If the executive council were wished there could be appointed as a
patron member of any learnt virtues and social welfare person in this area.

(a) Any
man or woman who lives permanently in the working area and will be come to confident
to the view and objects of the organization and those who will be up of 18
(Eighteen) years age, only they could be applied for the membership post by the
fixed admission Form of the organization.
(b) There
will be paid Tk. 50/- (Fifty) for admission and monthly Tk. 20/- (Twenty) for
each male/female member
(Three)
Application for the post of
membership and through the recommendation of a member of the executive council
and there would be happened through the approval of the executive council.
(Four)
This organization shall be the right
to consideration approval and
withdraw of the application.
(e) Any
person could not be achieved the membership post of this organization due to
the liability of moral depraved.
Article No. 08 (Eight): Invalid of Membership Post:
(a) Any
member of the organization be not to paid the monthly subscription for each
three consecutive of month.
(Two)
It any member of the Organization be
engaged to the anti-conduct of the Organization/Enterprise or of the State.
(Three)
If be made resignation or be died.
(Four)
If be done or engaged for any work
to the anti-position of the view and object to the Organization.
(Five)
Any member of the Executive Council if be
happened to absent for the 5 consecutive
meeting of the Executive Council.
(Six)
If be convicted by the Court.
(Seven)
There would be provided for
one-month time to make self-explanation or self-reformation before discharge of
any male/female member.
Article No.- 09 (Nine) :
Recover of the membership post :
It any
member be lost of his/her membership post/withdraw of it, there will be made an
undertaking and will be made apply and if the executive committee be pleased,
his/her membership post could be made recover. In this case he/she must be paid
all the dues of the organization.
Article No. 10 (Ten) : Right
to the general members:
(1) There
will be fully informed to the accepted programs of the organization including
the view and objects of the organization.
(2)
Each of the members will have the
voting right.
(3) Each of the valid members could be made
contest in the selection.
(4)
Facilitates of any body will not to
be eligible to transfer of it.
(5) All the general members will be approved
of the budget.
(6) The general members will approve the
yearly work-plan.
(7) The general members shall be remained as
the power of over all power.
(8) There will be right for all in working
to all the Govt. activities.
(9) Every
body should be equally worked to the home
and abroad and worked Govt. programs for its implementation.
(10)
The general members will be informed
to the income-expense account for all activities of the organization.
Article No. 11 (Eleven) :
Duties and responsibilities :
(One)
To provide assistance to establish
of Fund.
(Two)
To provide co-operation for the over
all development of the Society.
(Three)
To make cordial co-operation and
assistance given including of the admission fee, monthly contribution.
Article 12 (Twelve) :
Structure of the Executive Council :
The infrastructure of the Executive Council to this Organization will
be 5 (Five) members. The Executive Council will be elected by direct vote of
the General members for the period of 2 (Two) years. There must be mentioned of
the designation of each member. The infrastructure of this Council will be as

Article 13 (Thirteen) : Election Process:
(One)
Duration period of the Executive
Council to this organization will be 02 (two) years. 30 (thirty) days before
fill up of the duration period in the meeting of the General Council, there
would be formation of a 3 (three) members based Election Commission. This Election Commission will be taken of all
arrangement to the next Executive Council Election as per the rules.
(Two)
After the newly elected executive
council election and within the 15 (Fifteen) days, there will be taken for all
the responsibilities of the organization.
Article No. 14 (Fourteen): Works of the Executive Council
:
a) To obtain and implementation of the
programs and aims-objectives for the constitution of the organization.
b) Yearly work plans and prepare of budget,
annual audit, prepare of bulletin and to make approval in the general meeting.
c) To
do make up to date of the accounts.
d) To
keep communication with the Govt. and Non-Govt. organization.
e) To
invite the meeting of this council at least one time in a month.
Article 15 (Fifteen): Duties and
Responsibilities of the Executive Council :
The President:
Generally the president will be kept observation to all the activities of
the organization. He will be presided over in all of meeting, if be found the
conduct of any male/female member in anti-disciplinary or to be found for the
break down of the discipline, then the President must be taken the step for the
arrangement as per rules. He/She could be supported or approved for any
proposal. If be failure to take decision in any complex non compromised matter and by his own casting
vote, would be come to final decision with the casting of his own vote. About
different project preparation matter, he will be made council with the members
and will approve. He will be approved the monetary expenses of the
organization.
Article No. 16 (sixteen) : General
Secretary :
The
General secretary will be performed about the duty-liabilities of the
organization as a speaker.
Such as:
a) To obtain programs and implementation as per the constitution of
the organization.
b) To
invite of the meeting, decision writing and reservation.
c) Work
distribution in different branches, supervision and council given.
d) Reservation
of the documents and control.
e) To
contact with all the Govt. and Non-Govt. enterprises.
f) Prepare
of pre-report of the meeting and to place of it.
g) He would be selected of the
member-secretary of the employment board as per his right to the post.
h) To
make current of the accounts, reservation and to make auditing.
i) He will be acted for done of the duty as the Executive Director
to the right of his post.
Article No. 17 (seventeen) : Treasurer:
Admission
fee of the member, monthly contribution, gift and grant by the gentle man,
Govt. and non-Govt. subscription etc. will be accepted by the receipt performed
for keeping the accounts with the counseling of the President and the General
Secretary.
He will be
spent the money with the written documents and the collected money will be
deposited in to the Bank in properly.
For the
benefit of the running work, he could be kept Tk. 300/- (Three hundred) in
hand.
Article No. 18 (Eighteen): Executive member:
The President/General Secretary give power
could be maintained and he/she will be maintained to the role of different
sub-committee.

Article No. 19 (Nineteen): Employment Rule:
To
implement the aims and objectives to the public interest and adopt of the
Development program and to the view of the implementation and if be needed to
appoint any employee and for it, there will be constructed an employment board
as per the decision of the General Council.
Article 20(Twenty) : Meeting :
a) Meeting of the Executive Council :
(1) There will be held meeting at least one time in a month.
(2) This will be invited providing 7(seven)
days notice of this meeting.
(3)An urgent meeting to be invited, a 24
(Twenty four) hours notice should be
needed.
(b) Meeting of the General Council:
(1) This kind of meeting will be held one
time in a year.
(2) The meeting should be invited at least
15(fifteen) days notice.
(3) An urgent meeting will be invited for
3(three) days notice.
c) Postponed Meeting:
(1) The
postponed meeting of the Executive Council will be held for 3(three) days
calling notice.
(2) The
postponed meeting of the General Council will be held within 7(seven) days
notice.
d) Called
Meeting :
If the
general council or the Meeting of the General Council/Meetings by the president
of the organization or the General Secretary if not to invite or become unable
or to failure then as per the rule and in the primary stage, two of members of
the third relevant council and for inviting of the relevant meeting, there will
be invited to the favour of the president. If he does not invite of the
relevant meeting within 15(fifteen)
days, or to be unable or to be failure, then within the next 15(fifteen)
days and for inviting of the said
meeting, by the combination
of similar number of member and again to the favour of the general
secretary, will be applied. If he also be such kind of unable and to be
failure, then by the two parts member
from the three part of the relevant council and by their signature, the invited
meeting will be recognized as the called
meeting. The accepted decision in this meeting, shall be treated as the final.
But in favour of such kind of decision, it must be obtained for the
approval of the Registration Authority.
Quorum of the Meeting:
(1) The quorum of the Executive Council
Meeting, General Council Meeting and Postponed Meeting with the presence of two
parts members present from the three parts and with their compliance.
(2) In the urgent meeting of the said
council, the quorum will be fill up by the presence and compliance of one part
member present from the three.
Article No. 21(Twenty one): Branch of the
Organization:
There could be opened for the branch office
through the approval by the Registration Authority.
(a) Constitute of the branch committee and
its structure:
As per the
constitution of the organization, in the area where the branch will be opened
and after taking the members of this area, there could be formed of the
committee. The said branch committee of its President, General Secretary,
Treasurer and 2 members and by combination of it, there will be the form
of 5(five) members. The branch committee
will be approved by the central committee and to be controlled and will be
elected by the general council.
(b) The
Common Rules of the branch will be as the center. The central committee at any
time can be stopped to the activity of the branch committee and the decision
for any matter of the branch committee
from the center will be treated as final.
Article-
22 (Twenty two): Income: Expense
The
principal source of the organization will be the admission fee of the members
from the organization, the monthly subscription gift-grant from the gentle
persons Govt. and non-Govt./Foreign Grant and received money from the adopted
programs etc.
Expense:
For the implementation of the programs to the organization and for the
development of the programs to the public interest and for training and production
base work, the fund of the organization will be expensed.

Article
No. 23 (Twenty three): Accounts:
(a) The
elected Treasure by the members of the organization shall be preserved the fund
of the organization.
(b) All of
the foreign grant getting to the favour of the organization, there would be
reserved by only an account of any schedule Bank of Bangladesh. The president,
General Secretary and the Treasurer of the organization and by the signature of
any two of them, there could be opened of the savings account/sub-account and
could be conduct of it.
(c) The
money from the bank would be withdraw as per the decision of the executive
committee members
(d) The
documents of the organization and the information shall be reserved in own
office
(e) Any money
could not be kept or hand over than 24 hours.
(f) The
accounts should be made of updated.
(g) The
general secretary for performance of the urgent work, there could be kept at
least not than up of Tk. 1000/- (One thousand).
Article-
24 :
Account
Audit:
This
organization/society will be made of auditing about the income-expense of
yearly by the audit firm which is registered by the registration authority and
would be submitted to the registration Authority.
Article
No. 25 (Twenty five) :
Amendment
: In the constitution of the organization for any article, sub-article word and
words, sentence or needed to make change, enlarge, addition or correction,
there will be needed of invite meeting for the council and will be present
there two parts of the member from the three parts and with the compliance of
them, the amendment proposal would be brought. In favour of the brought
amendment and after obtain permission from the registration authority, the
amendment could be made effective. But in any stage, the approved named of the
organization or part of the name there could not to be made of change or
correction.
Article-
26 (Twenty six)
In the
constitution of the organization and in the work principle, any thing is
remained either in written or unwritten, the 46 No. Ordinance of 1961 and
Foreign Donations (Voluntary Activities) Regulation Ordinance, 1978 and of its
regulations, all the activities would be conducted.
Article
No. 27 (Twenty Seven):
Winding
up:
If it is
not possible to be run of this organization or to be come in dis-moving or to
be happened a fully inactive, then as per rule, there will be invited of the
General Council meeting of the Organization as per rules and at least the
presence of three parts member from the five parts and compliance of them, the proposal for winding up would be brought.
In favour of the brought winding up proposal and after approval of the
Registration Authority, the winding up would be made effective. Besides, if
there are existing sufficient evidences to the hand of Registration Authority
as the organization is working about the anti-social and state-betrayal works,
he/she would be taken step to winding up of the organization. There must be
transferred for the movable property of the organization to the Registration
Authority or its nominated representative . These properties shall be reserved
as per the Govt. Principles.
: The End :
The Constitution of CENTER FOR
REHABILITATION OF TORTURE SURVIVORS (CRTS) is accepted and approved on full
compliance in the meeting of the General Council which is held on the dated
- 08/10/2004.
