The
1st Party : Poultry Feed Manufacturer and Marketing Organization
The
2nd Party : Transport Agency, Whole Bangladesh Goods Transport
Organization.
This is hereby the parties on the following terms
and conditions, goods of the 1st party to reach in the fixed place
by the 2nd Party and for surety of it is engaged to this contract.
TERMS AND CONDITIONS:
1. According to the demand and
schedule of the 1st party, the 2nd party shall be bound
to supply of the appropriate Truck, Pick Up, Covered Van etc. vehicles.
2. The 2nd party
shall be received with understand of the goods as per Challan/Invoice and D.O.
and to the directed place and person organization of the 1st party
will be given understand of the goods and will be received of the acknowledge
marked document and to be returned to the 1st party.
3. The 2nd party
must be made sure for the matter of vehicle transport by such a Driver who is
an skill, person with cool brain and not of a drug addicted person.
4. During the period of goods
transport of the 1st party, if there is occurred any kind of
accident and if it is seen after proper investigation that there was not fault
of the vehicle driver and in this case, the 2nd party shall not be
liable, rather this, there will be considered of the matter as per act of the
God.
5. In the case of vehicle
Transport, 1st party will pay the vehicle fare to the 2nd party as
per attached list. In this case, without the renewal of the contract, change,
the aforementioned vehicle fare could not be increase in any stage.

In
the event of the Holy Eid-ul-Fitr and Eid-ul-Azha, before and after of 7(seven) days, there will added .03
paisa with the mentioned Fare Rate.
6. After receiving of the goods
from the 1st party by the 2nd party, if not to be made
reaching to the appropriate place, person organization directed by the 1st
party and if there is made an unnecessary late, to move goods in other
place, to sale, to exploit, to make
forfeit and to break down of the faith etc. any kind of activity and for it,
the Driver and the 2nd party shall be liable and fully goods compensation shall be bound to give by the
Driver and the 2nd Party. But the case of dacoit, kidnapping, catch
fire and accident related matter, the 2nd party shall party shall
not be liable. But after properly investigation and if the turned to a guilty,
the Driver shall be liable.
7. Due to un-carefulness of the
2nd party and if the goods of the 1st party become
damage, the 2nd party shall be liable.
8. During the period of the
contract, the 2nd party could not be stopped of the vehicle supply
at any stage.
9. The 1st party
will not be given of the work order to any other Transport Authority during the
period of contract. But to this matter, the 2nd party must be made surety
to supply of the transport vehicles.
10. Duration of the contract
shall be valid up to 5 years. But in this case, the fare also is unchanged. But
the price of the fuel Oil if there is increased about 3 taka per kg, fare shall
be re-fixed through the compliance by both of the parties.
11. Through the discussion with
the 1st party and to the guarantee for to obey of the terms and
conditions of the contract/agreement, from the own account one of the date less
50,000.00 taka (fifty thousand) cheque will be given to the 1st
party as maintaining a security of the contract.
12. All other matters shall be
followed according to the existing rules of the country.
Therefore,
in self-willing, in full of sense, without influence of others and after read
out well about the ground of the contract/agreement and with the understanding
of it and with an undertaking to obey properly of the contract/agreement, in
presence of the witnesses, we were signed of this contract/agreement.
