EMPLOYMENT CONTRACT


This Employment Contract is mad and entered into on this day............. month of .......2007 between.........................................(Herein after called the Employer) and Mr....................................................... Passport No: .................................. (Herein after called the Employer) both of whom bind themselves to the following terms and condition:-

Now it is hereby agreed as follows:-
1) Employee's Job Title or position

2) Duration of Employment Contract
a) The validity of this Employment Contract is 3 years commencing from ...................
b)         The Employee shall serve a probationary period of 6 months from the date of arrival during which the employer ma terminate his employment if the employee does not perform his work to the requirement/satisfaction of the employer. The employee should note that the employer shall have the sole discretion to determine whether the work performed by the employee is of satisfactory standard.

3)         Job Duties and Responsibilities ]
            The employee shall perform the duties of which he has been engaged or assigned to him by Employer/supervisor with good working attitude, discipline, honesty, integrity at all time.
            He must be able to complete the duties/works which has been assigned to him.

4)         Working Hours
            Daily basic working hour is 8 hours (8.00 am to 5.00 pm), 6 days per week. Please note that the employee may require to work in different time shift  according to the particular project operation requirements. However the employee will be notify if such condition took place.

5)         Salary
            Basic monthly salary is RM 30.00 (Ringgit Malaysia : Thirty Only) per day of 8 hours. The employer may adjust the daily wages rate from time to time depending on the employee's individual performances on their works.

6)         Overtime
            The employer shall pay the employee with the following rates after the basic working hours (8 hours):-
            a) The following next two hours (5.00 pm to 7.00 pm) will be calculated as X 1.5

7)         Government and Immigration
            The employer will pay in advance the yearly government levy and immigration fees of RM 1,200.00. The employer will deduct the amount from the employee's salary on 12 equal installments.

8)         Yearly Medical Examination
            Yearly medical examination will be arranged as required by the Immigration Department of Malaysia and cost incurred will be borne by the employee.

9)         Traveling Expenses
            The travelling expenses form Dhaka, Bangladesh to Kula Lumpur International Airport shall be borne by the employee and the expenses of the air passage from Kula Lumpur International Airport to Dhaka, Bangladesh shall be borne by the employer upon completion of employment contract (3 years).

10)       Accommodation
            Accommodation with water and electricity facilities shall be provided  by the employer. One Set of cooking facilities such as gas and stove will also be provided to each group of 8 workers. Any requisition and cost of replacement should be borne by the employee.

11)       Leave Benefits
            The employee are entitled to 8 days of annual leave and 10 days of public holidays yearly. However the employee who wishes to take leave must obtain prior written approval from the employer.

12)       Medical Benefits
            The employer shall bear a sum of RM 50.00 (Ringgit Malaysia : Fifty Only) medical fees yearly to each employee.

13)       Insurance
            The employee shall be insured under the Employee's Compensation Scheme Policy effective from the date of commencement of the employment contract in Malaysia.

14)       Decease
            In the event of any employee dies in the cause of his employment, the employer shall be responsible to arrange for the body of deceased to be repatriated to his next of kin at their respective country and necessary repatriated expenses shall be borne by the employer.

15)       Confidentiality
            The employee undertakes not to furnish any third party or parties either during the term of this agreement or at any time any information acquired by the employee pursuant to this agreement save to the extend that the employee may be required to do so by law or authorized in writing by the employer in order to fulfill its obligations and performs its duties under the terms of this agreement.

16)       Company's and Hostel's Rules & Regulation
            The employer reserves the right to amend the clauses in the company's and hostel's Rules and regulations without prior notice from time to time, therefore the employee are advised to refer to the company's site supervisor or hostel notice board for the updates.

17)       Restriction
            a) That the employee shall not marry with any Malaysia and shall not participate in any political activities and activities of those connected with trade union in Malaysia.
            b) That the employee shall not change his employment during the contract period or shall not carry or do business without the written permission from the employer.
            c) That if the employee is found to be creating social problems, immoral activities and or engaged any illegal subversive or criminal activities that breaches with the law of Malaysia or causes any kind of darnages to the company's properties, do not follow the company's and the hostel's rules and regulations the said employee would be .................. immediately and will be repatriated to his country or origin on his won expenses after the said employee had pay back the employer for all the advances, outstanding levy and other expenses which the employer had paid in advance on behalf of the said employee.

18)       Termination of Employment Contract
            The employer reserves the right to terminate this agreement by serving one day's notice to the employee on the occurrence of any of the following events:-
            a) If the employee breaches any of the restriction in clause 17 above or is convicted of any offences under any law of Malaysia.
            b) If the employee's employment pass is with drawn by the Malaysian authorities for any reason whatsoever.
            c) If the employee is absent from work or failed to report for duty for more than two
            (2) consecutive working days without a reasonable excuse or employer's prior consent.
            d) If a doctor certified that the employee is medically unfit for employment.
            e) If the employee breaches with any terms and conditions of the employment contract, company ad hostel rules and regulations, the employer will not compensate whatsoever due to the contract period upon submission of wirtten notice .
