Acout giving gas connection at Municipal Holding No- 578/517/494(Kqa) under Old
Chowdhury Para of Comilla City.

Kazi Basahr
Saheb was the owner of above mentioned holding situated under Chowdhury Para of
Comilla City. Kazi Abul Bashar purchased the land in Sub-Kabla Deed editted and
registered of 29/07/68. He permitted his nephew (Son of sister) Kazi Golam
Moinuddin to stay here as care taker. Meanwhile, after immmature death of Kazi
Abul Bashar, his mother gave the land to his two grandson that means two sons
of Kazi Abul Bashar in deed of gift editted and registered on 24/09/2008. The
two sons of Abul Bashar became the owner of the land in deed of gift and
according to inherit.
The sons of
Kazi Abul Bashar are living in Dhaka. They gave opportuinity to their cousin
Kazi Golam Moinuddin as prior position.After the death of Kazi Abul Bashar, his
nephews using their grandmother making another woman as donor created a deed of
gift and showing the deed of gift created municipal holding. The sons of Kazi
Abul Bashar at Comilla Pourashava against holding submitted objection, their
holding is rejected.
Recently
applicant knew that, showing rejcted holding No they brought gas connection
above mentioned house which No-2D-13859, Connection date: 19/12/2000, receiver
Kazi Golam Moinuddin. Actually Kazi Golam Moinuddin or his brother Kazi Golam
Kutubbuddin is not owner of the house. So gas connection cannot be in their
name.
Mentionable,
Kazi Golam Moinuddin being plaintiff at first judge court in 1993 filed case of
104 No civil distribution, in which order for keeping stability regarding type
change of the complainant house. The case is underway.
We request
humbly to the court to pass order declaring ownership of gas connection in this
situation in the name of two sons: Kazi Mahbub Ahsan and Kazi Md. Mohsin of
actual owner late Kazi Abul Bashar.
