We, signatories in
bellow, declaring with oath that,

First party is
uncle of the orphans and on the other hand, second party is ant of the orphans.

Orphan’s mother Sonia Sultana got married with orphan’s father Md. Moshiur
Rahman (Sukhon) on September 17 in 2004. Later, orphan’s father Md Moshiur
Rahman involved himself in extra marital relation with a girl name is Marina
Haque. Due to addicting himself to the illegal relation, his business witnessed
so recession. Later, orphan’s father MoshiurRqahman demanded dowry from his
wife Sonia Sultana but she denied giving any money to her husband. Following
the denying giving dowry and adultery matter, orphan’s father on July 25 in
2015 at night taking help from others killed orphan’s mother.

Later, a case was filed against orphan’s father along with alleged others andMoshiur
Rahman had been arrested. Then, orphan’s grandmother and ant (Father’s sister)
flew with the orphans putting lock at door because they also alleged. As other
alleged persons who were facing trouble in fleeing with the orphans, Uttara
West police station S.I Mr. Jahangir Alam managed to keep the orphans in the
maintenance of second person. Mentioned the murder case is in trial in Women
and Children Repression Prevention Tribunal in Dhakaand case No 06/016,
Article: Women and Children Repression Prevention act 2003 of 11 (A)/30”
article.
4.Orphan’s
father was able to get bail from honorable high court giving false statement in
the murder case and coming outside from jail he knows that important two
witnesses 12 and 13 No are orphans Md. Jamiur Rahman (Nehal) and Md. Tanzilurrahman (Niswas) in the case.
Aiming to halt the orphan’spresence in the court as witness, Moshiur Rahman for
keeping the orphans in his maintenance filed petition in Dhaka Metropolitan
Court according to article No 100 of criminal procedures, which case No
67/2016. In that case, honorable Supreme Court taking all matters in its
consideration ordered to keep orphans in maintenance of second person. Now, the
orphans are in the maintenance of second person.

Later, respondents of the case filed criminal petition for leave to appeal
which No 503/016, after in end of hearing in presence of both party, Combined
bench formed by chief justice of Bangladesh 1 No bench, rejected bail order of
No1 convicted orphan’s father Moshiur Rahman and stating that up to being
settlement of women and children case No 06/016,Moshiur Rahman was directed to
stay in Jail. It mentionable that orphan’s father Moshiur Rahman pleads bail
filing criminal review petition No 64/016 to the Appellate Division of
Bangladesh Supreme Court but the bail seeking was dismissed.
6.MoshiurRahman’s
father is dead and he has no any bothers. But three sisters are married. One is
divorceeliving at MoshiurRahman’s house. His sisters knew that if the murder case
is proved, then Moshiur Rahman definitely will be hanged. In the perspective,
second party understood that Moshiur’s sisters can kill the orphans to seize
all property of him and can keep refrain the orphans from witnessing in the
court against them. Since, on 04/10/2016, Moshiursister Sumi and relative Amdad
threatenedsecond partyover phone regarding orphan’s witness in the court.
Sincethe
second party informs the first party about that, it thinks the orphans are not
secured to the second party and second party also thinks that the orphans are
not safe to its own maintenance.
Since,
first party is a senior official of police, so thought that the orphans will be
safer to first party instead of second party.
In
this perspective, second party declaring through the affidavit that,
Having in his
trust (1) JAMIUR Rahman (Nehal) , Nick
name Jami Soona, Age 9 years and (2) Tanzilur Rahman (Niswas), Nick name Sami
Soona, Age 6 years, Mother late Sonia Sultana, Father Md. Moshiur Rahman
(Sukhon), transferred orphans to the first party on 09/10/2016, Bangla 24 Aswin,1423on
Sunday. From today, first party will take all responsibility of the orphans.

party declaring that on 09/10/2016, Bangla 24 Aswin,1423, on Sunday, from
possession of second party (1) JAMIUR
Rahman (Nehal) , Nick name Jami Soona, Age 9 years and (2) Tanzilur Rahman
(Niswas), Nick name Sami Soona, Age 6 years, Mother late Sonia Sultana, Father
Md. Moshiur Rahman (Sukhon), got with understand. First party will rear the
orphans through its own cost. We both party declared to make come the affidavit
to the public. The enforcement of this document started from today 09/10/2016,
Bangla 24 Aswin,1423, on Sunday.
