An Agreement

More higher than price agreed with the petitioner by proforma invoice from the Respondent No. 1. The  has become very much afraid for this and if required measures are not taken to prevent this misdeed  by the Respondent No. 1 , the Petitioner would face  great loss. If the misdeed of the Respondent continues , the Petitioner shall face irreparable loss, which would not be full filled in exchange of money. So, the Petitioner being compelled lodged this case at the court for remedy.

11. The merits of the case are in favour of the Petitioner, but in disfavour of the Respondents

12.  It would be rightful to bar the Respondent No. 1 by issuing order of temporary injunction or interim injunction from importing Telegram - P-250.00/ML from Respondent No. 2 and 3 through proforma invoice during continuation of the case and adding or including the  name of the Respondent No. 1 altering the registration certificate issued to the Petitioner from the Director, Drugs Administration.

13. It is very rightful now to bar the Respondent No. 1 issuing an order of temporary injunction view to removing the complexion of the case.

Therefore, Prayer is to issue an order of temporary injunction to the Respondent No. 1 for justice showing notice for explanation so that the Respondent No. 1 could not add or change his name in the registration certificate issued from the Director, Drugs Administration illegally and secretly and the Respondent No. 1 or any one except the Petitioner could not import or marketize the  medicine Telegram -P- 250 IV/ML from the Respondent No. 2 by proforma invoice in Bangladesh   

And the Hon'ble Court shall be pleased to the  bar the Respondent No.1 by issuing order of temporary injunction or interim injunction - before issuing temporary injunction.

To the welfare of helpless, neglected and deprived human childs of the society and preserved of their right, in the light of Qu’ran and Hadith, in  year 1983 AD and with the insertion of Alhaj Md. Safiq Ullah (former Parliamentary Member) and cordial effort of some succeeded sons of Luxmipur, there were founded Darul Aman Academy (Orphan House) and Madrasha-e-Darul Aman Academy (Alim). For the purpose of smooth management and operation and taken more other welfare base programs, there was established Darul Aman Trust.  Under this Trust, there are conducting at present Orphan House, Madrasha, Mosque, 2 separate Forkania for the men and women, assistant  given to the distress, medical aid to the patient including more other programs. But due to matter of sorrow that on the dated 14/11/2001 AD, only one of my son Sumon was left of this world after making empty of the chest of parents. At present between with too much help less condition, I have been running treatment of my daughter Soma with much trouble. To do live Soma, for the purpose of his treatment in each of the month 7/8 thousand taka is expensing. Of which on behalf of a shop employee like me is come to impossible. According to the Opinion of doctors, she will be come round if there is made her Bone Meru Transplant  in abroad or in the neighbor country in India. For which cause, there will be needed 15(fifteen) lac taka. I may inform to you that such  a poor father like me, there is not possible at all for the purpose of upgrade treatment of my daughter to take to the foreign country.
