More higher than price agreed with the petitioner by proforma invoice
from the Respondent No. 1. The has
become very much afraid for this and if required measures are not taken to
prevent this misdeed by the Respondent
No. 1 , the Petitioner would face great
loss. If the misdeed of the Respondent continues , the Petitioner shall face
irreparable loss, which would not be full filled in exchange of money. So, the
Petitioner being compelled lodged this case at the court for remedy.
11. The merits of the case
are in favour of the Petitioner, but in disfavour of the Respondents
12. It would be rightful to bar the Respondent
No. 1 by issuing order of temporary injunction or interim injunction from
importing Telegram - P-250.00/ML from Respondent No. 2 and 3 through proforma
invoice during continuation of the case and adding or including the name of the Respondent No. 1 altering the
registration certificate issued to the Petitioner from the Director, Drugs
Administration.
13. It is very rightful now
to bar the Respondent No. 1 issuing an order of temporary injunction view to
removing the complexion of the case.
Therefore, Prayer is to issue an order of
temporary injunction to the Respondent No. 1 for justice showing notice for
explanation so that the Respondent No. 1 could not add or change his name in
the registration certificate issued from the Director, Drugs Administration
illegally and secretly and the Respondent No. 1 or any one except the
Petitioner could not import or marketize the
medicine Telegram -P- 250 IV/ML from the Respondent No. 2 by proforma
invoice in Bangladesh
And the Hon'ble Court shall be pleased to
the bar the Respondent No.1 by issuing
order of temporary injunction or interim injunction - before issuing temporary
injunction.
