Result of the conduct and investigation of the Case:
When the
Plaintiff/Complainant on 10/06/2004 at 11 AM. reached Baragaon Village on the
way going to Dhaka by bus the witness and Plaintiff challenged the accused Rafiqul
Islam on suspicious. After Rafiqul Islam abounding the bus with a handbag.
As a result of the challenge of the Plaintiff and witnesses jumped on the
Rafiqul Islam than, Seized the above symptoms by searching his bag. But when
the Accessed fled away but his accomplice Belayet Hossain was handed over to
the duty Officer of The Police Station.

The Duty Officer files this regular Case by taking the
written complain of the Plaintiff. By the order of the Officer in Charge I took
the responsibility of the investigation of the Case.
By receiving the Report of the Ballistic Experts and
submitting the result of the investigation to the senior Police Officer and
learned Public prosecutor, they agree with my investigation and after submit
the complaint to the Kaligonj Police Station according to section 19 (A) and
(Cha) of 1878 Arms Act. 8/10/2004, the complain No. 345. It is requested to
issue to warrant the witnesses will probe the evidence at the Court. The
Symptoms are kept in Malkhana.

effect that,
I am the General Secretary of Bangladesh National Student Party,
Mukhtarpur Union Branch. To day at about 11 am. on my way to Dhaka
from Saoraid Bazar by bus. The accessed Rafiqul Islam got on the bus at
Baragaon with a hand bag. We suspected and challenged him. For our challenge.
The accessed Rafiqul Islam tried to get down from the bus. We hugged him
together searched his bag and recovered
a fire Arm. We made the magazine of Arm opened by the accessed and found that
there were 6 round live Cartridge. On interrogation the accessed Rafiqul

Baragaon (3) Abdul, S/o. Mojaffar Ali

Alamats have been listed
in Sl. No. 1,2,3,4. All the witnesses of the state have tried to arrest the
accessed persons with open arms but could not arrest them as they are man
terrorist. Though the matter of recovery of arms is not mentioned in the Ejahar
the aced Late Belayet Hossain and all the Pws admitted the matter in their
statement U/S 161 C.R.P.C and in their evidences given before the Court. The accessed
on bail have cross-examined the Pws. Consulted the cross-examinations of the
learned lawyer of the accessed persons on bail. No proof of the involvement of
the accessed Ahmed Hossain on bail is found in the cross-examination of the
learned Lawyer. Sufficient reason exists to believe that the accessed (1)
Rafiqul Islam (2) Khairul Islam (3) Abdul (4) Akbar Hossain (5) Md. Belayet
Hosain are directly involved with the occurrence of the Case. Because, the
accessed persons could appear and contest the case if they would not have been
involved with the case. Not doing that they are involved in the terrorist
activities for political reason. On the consultation of the related facts and
circumstance of the Case. I have arrived at the decision that the accessed
persons were involved in the occurrence of the Case and they have committed the
offence U/S. 19 (A) and (Cha) of the Arms Act. 1878. Hence it is ordered, the
accessed Persons (1) Rafiqul Islam, S/o. Ali Ajgar (2) Khairul Alam, S/o.
Wajuddin of village – Baragaon (3) Abdul, S/o. Mojaffar Ali (4) Akbar Hossain,
S/o. Raham Ali, village – of No. 3 is Nargana and that of No. 4 Jamalpur (5)
Belayet Hossain, S/o. Karim Bepari are found and decided to be guilty in this
Case. Finding the accessed persons guilty. The accessed pesons 1 to 5 are
convicted to suffer 7 (Seven) years R. S. for the offence U/S. 19 (Cha).

C.R.P.C. This accessed will lead his life freely.

Health Complex and seeing there condition deadful the Authority sent them to Gazipur Sadar Hospital.
The wounded victims were sent by ambulance to the Hospital. At present their
condition is very doubtful to survive.
Therefore, it is my prayer considering my application
as FIR please take necessary action for arresting the accessed and to give them
punishment after proper investigation. The End.

14/0056 Dhaka Metro. The Dacait were snatching
away money and articles from the Passengers. We along with some local people
tried to catch and detect the Dacait who then started firing at different
directions with 303 Rifle.

Result of
the conduct and investigation of the Case:
Report of the FIR of the Case is as follows : The plaintiff complainant
on last 10/01/04 brought out a procession as per previous decollation of the
Chatra Dal. On that day they got preparation of the procession from Jamalpur
Degree College and on the way of coming to Kaligonj Upazila, when they reached
Khalapara Primary School 1-10 No. Accused all on a sudden attacked the
procession as per preplan. The Accused attacked the procession by blasting
local made Cocktail, 303 Rifle and created a panic situation by indiscriminate
firing. By indiscriminate firing and cocktail blasting of the accused, the
victims was seriously wounded. Hearing sound of indiscriminate firing and
cocktail blasting people of the surrounding area were coming to the place of occurrence.
Seeing this the accused started firing by there illegal 303 rifle. The Victim
were cocktail blasting the wounded victim by the help of the surrounding people
were admitted to Kaligonj Upazila Health Complex. As the victim Md. Shahin
Miah, Victim – Alamgir Hossian, Victim – Anowar Hossain were seriously wounded
so they were sent to Gazipur
Sadar Hospital
and they were given treatment there. Getting written application filed the Case
as duty officer. I was given responsibility of investigation of the Case after inspection
of the place of occurrence. After investigation I drew a map and made a
schedule. Interrogated the witnesses. Recorded statement of the witnesses under
Section 161 of the B.P.C Examined the victims. With the matter of Case arrested the accused
Sirajuddin. Tried to arrest the accused mentioned in the FIR. As the accused
were absconding so it was not possible to arrest them. As per report of the inferences
prepared statement and took signature from them and then submitted the report
to the Higher Police Authority. The Higher Authority was in the same opinion of
mine. The learned public prosecutor is in the same opinion with me. I submitted
the Charge Sheet No. 302, Dated: 30/5/04 Under Section ¾ of the Arms and
Explosive Act of the year 1908. The witnesses will prove the Case in the Court.
Informed the result of the Case to the Complainant.
