“Extermination House Rent Agreement”

This “Extermination House Rent Agreement” is performed on the dated 26th September, 2009 AD between the parties.

“Mumtahana Lodge” named real estate, of which Mirpur Section-10, Block-B, Road No. 7, Plot No. 10, P.S. Mirpur, Dist. Dhaka is situated.  The owner of the said “Mumtahana Lodge” is Mr. Mosharraf Hossain, son of late Mvi Adam Ali Majumder. If there is not happened any other, this of his identity shall be applicable to his heirs, legal representative or administrator, appointed owner or present and future heirs are included.

---The Owner/First Party.

Md. Muhammad Jobaidul Kadri (Ripon), son of Mr. Md. Abdul Bari, at present – House No. 4, Road No. 17, Block C, Section-10, Mirpur, Dhaka, permanent address : Village – Muslim Nagar,  Post Office – Muhishkuri, Police Station – Daulatpur, District – Kushtia. If there is not happened any other, this of his identity shall be applicable to his heirs, legal representative or administrator, appointed owner or present and future heirs are included.

This “Extermination House Rent Agreement” is hereby describing in the followings:

As the First Party in the following described schedule including of the described house in full sixteen anna enjoyer remaining and as the First Party schedule described house is wished as monthly Extermination House Rent, and

As the second party taking with the family members in the schedule described house, for the purpose of residing, there has been given proposal for to take as monthly Extermination House Rent to the First Party.

As  the First Party schedule described house due to the following written terms and conditions, to the second party for monthly Extermination House Rent has been consented and the second party has been accepted it and for this ground, under the following terms and conditions, this monthly “Extermination House Rent Agreement” is performed:

1)      This Agreement Deed will be effected since 1(one)st October, 2009 AD and will be effected 30th September, 2011 AD for about 02(two) years.
2)      The second party, schedule included house for the purpose of space rent in each month Tk.5,200/- (Taka five thousand) only to the first party in cash money or through the cross cheque of any bank in Dhaka by own name will be paid that means rent of each English month within the first week of that month after given to the first party, the second party will be taken of the necessary receipt.

3)      The second party to the favor of the schedule included house, according to the power meter and gas bill in each month will be paid regularly and the original copy of it will be transferred to the first party.
4)      The second party if not to be paid power bill and gas bill in regularly, there will be made disconnect of the gas and electricity connection. Gas and Electricity Bill and Rent if comes due, all kinds of dues for to collection from the second party by the first party, such kind of power will have the first party and from the schedule described house for extermination power will have the first party.
5)      Within the first week of any month, if there is not paid rent to the first party by the second party, within the last day of that month, after pay the rent by the second party and would be leave of the house or there will have the right to exterminate of the first party to the second party and will have right to collect of the dues money.
6)      The second party at any stage, the house could not be given rent or sub-let to any other person or any other means could not be transfer. Roofs could not be transfer by the second party. If for the cause of default of the second party is stopped of the service pipe, then all kinds of expense for to clean up shall be borne by the second party.
7)      The second party for small type of repairing work, such as : Sanitary, Electrical, doors-windows and other kinds of glasses,  inner wall painting etc. will be expensed by own cost. The second party for any kind of change or extension could not be done and could not affix nail to the wall. But the first party each after three years, paining work of the  bill will be performed by own cost.
8)      The second party for sanitary work of the house, electrical hardware fittings, tiles mosaic, glass, service line etc. will be used in properly and in own  cost by own responsibility will be kept net and clean and usable conditions.
9)      The second party schedule included house will be used for only residential purpose. At any stage, there could not be used with unsocial, business and illegal activities.
10)  With the second party, doors-windows, sanitary, glass, electrical or infrastructure if there is come any kind of loss or for any activity of the second party if there is come any kind of any body of similar loss, the second party will be liable for it and the second party for similar kind of loss, should be bound to give compensation to the first party.
11)  The second party should have the social responsibility and through the doors and windows of the staircase, there could not be thrown any kind of wastage material. Dusts and wastage papers according to the existing rules there would be put down in the fixed place.  
12)  The Second Party during the period of leaving of the house, all kinds of fittings including the usable of whole the house that in what condition has been  received of the acquisition, shall be bound to make understand in that condition.

13) Water, Gas, Electricity as well as other kinds of service due to the cause of the relevant authority, if there is come insufficient, for it there could not be liable to the first part or for the insufficient service, if the second party is come to loss, for  it the second party could not be made demand of the compensation at any stage. In the relevant matter, if there is created insufficient condition and if there is needed of the water, expense money for tenants would be borne on equal rate by the tenants.

14)According to the meter  rental house used  electricity and gas bill, the second party shall be borne. But for the common natured works of the building as well as in the operation of safety and water pump, electricity bill and for general work, salary allowance of the employees shall be borne by first party.


15) Building and Building residing persons, to keep overall safety, keeping neat and clean, there will be given facilities in equal rate to all and for all applicable all of general rules and principles to maintain, the second party shall be bound.

16) The First Party or to the representative of the first party for to observation of location of the apartment and if be needed, the second party shall be bound to give entrance into the apartment.

17) The First Party for a large type and general nature other kinds of maintenance cost shall be borne and will be paid of the water and sewerage bill. The second party to the interest of all will be expensed water in  a measurement rate and will be come to aware for waste of water.

18) Generally from the period of Fazar Prayer calling to night 10.30 hours, the main gate of the building will be opened of the main gate of the building. That means from the period of 10.30 hours at night to Fazar prayer calling  for the purpose of safety, the main gate will be closed. For special need and without the previous approval, the said time table and rule could not be violated.
19) If there is agreed by the First Party and the Second Party, due to imposed of the new terms and conditions, this letter of agreement could be made renewal. In the similar case, the second party during the period of expiry of the agreement, according to the market rate, there would be agreed to increase of the monthly rate.

20)     Within the duration of the agreement, the first party will be given notice to the second party for one month, there could be able to cancel of the said agreement and according to this rule, the second party shall be bound to leave of the house. In similar case, the second party also if be wanted to leave of the house, there will be given notice to the first party on written basis for one month and could be able to cancel of this agreement. But during the period of agreement, the second party after stopped of the agreement, if there is wanted to leave of the house, paining works of it  will be performed by own cost. In that situation, the second party will be performed of the painting works according to the present existing standard.

21)     Children of all residing into the apartments and to the overall safety of the building, the second party could not be used the rooftop at any stage.

22)     The second party could not be able to make any kind of change or extension of the house and could no nail affix on the wall. But the first party each after three years, painting works of the building will be performed by own cost.

23)     Two months before of expiry of the agreement, to the matter of renewal, there will be informed to the first party by the second party about his wish on written basis and one month before of end of the agreement, new agreement letter imposing new terms and conditions will be performed. Otherwise, it will be seemed that within the last dated of the agreement, the second party would be left of the second party and shall be bound to understand of the first party by the second party in the solid stage, without encumbrance and liability less conditions of its real possession.

Dhaka District under the Mirpur Police Station, Mirpur Housing Estate of its ‘10’ No. Sectioin ‘B’ block of ‘7’ No. Road ‘10’ No. Plot situated multi-face house in the 4th floor of 8 No. Flat and relevant all kinds of fittings, fixers, meter etc. facilities are already rented.

After read out of the agreement, heard and fully known about the subject matter of the agreement, after seen and understood, in self-willing and full of knowledge and from the first and second party, there are performed signing with own signatures.
