The 1st and 2nd party of this Agreement is own co-brother and sister.

Subject : Agreement for payment of value within the fixed period of Flat House Sale in  
               the fixed period.

In the Uttara Residential Area, Sector-4, Road No. 14/C, 2 No. Plot and upon it constructed 6-storied building AnadaDhara named building 4th Floor to the West Side of the 3-B Flat area 2102 sq.ft. (including garage) of this Flat transfer reference Lease Acceptance Mrs. Nigar Sultana, wife of Late Joynal Abedin, House No. 24, Road No. 3/C, Sector-9, Uttara, Dhaka-1200.

It is expressed that Tanni Construction Ltd. and from it and for to take lease of the, there was made Agreement Deed by A.S.M. Aziz Ullah Swapan. After completion of the work and during the period of transfer, as A.S.M. Aziz Ullah Swapan was out set in the Bangladesh, the Flat as the elder sister of his wife Mrs. Nigar Sultana and by her name, according to the Rajuk Rule, there was made Registration in the Rajuk Office. Of which Registered Deed No. 698, Dated : 17.01.2004 AD and Mutation Ref. No. Rajuk Assist (Uttara)-2878, dated : 19/08/2007 AD.

It is mentioned that while paying the value of the Flat to Tanni Construction Ltd.  was took Tk. 22,71,000/- taka from  the sister-in-law named  Md. Manik  of A.S.M. Aziz Ullah Swapan as a Loan. When then  was made a proposal to pay the money of this loan in timely, the 2nd party of the Agreement Md. Manik was wished to buy the Flat in the market value.

Due to remaining in the repatriate of A.S.M. Aziz Ullah Swapan at present and on behalf of him, to take the value of the Flat, this Agreement was performed between the wife of A.S.M. Aziz Ullah name Mrs. Farzana Akter Runa (the first party of the agreement and Md. Manik (the Second party of the Agreement).

The principal matter of this Agreement the fixed price of the Flat Tk.73,57,000/- (Seventy Three Lac Fifty Seven Thousand), to the account of it, under stand from Mrs. Farzana Akter Runa and his elder co-brother and elder brother Md. Manik and younger sister Farzana Akter Runa, to pay her and to take understand of the Flat.

01.   Aforementioned 2102 sq.ft. Flat for each of sq.ft. presently market value Tk. 3,500/- (Three thousand five hundred) was fixed. Total value comes (2102x3,3500) = Tk. 73,57,000/-
02.   From the total value of the Flat the due money of the 2nd party Tk. 18,41,000/- (Eighteen lac forty one thousand) paid. Tk. (73,57,000-18,41,000) = Tk.55,16,000/- is due money.
03.   Cash money 15,00,000/- (Fifteen lac) was paid the second party to the first party.
04.   Rest = (Tk. 55,16,000 – Tk.15,00,000) = Tk.40,16,000/- (Forty Lac Sixteen Thousand) taka only.
05.   Rest Tk. 40,16,000/- (Forty lac sixteen thousand) taka one of the Bank Cheque will be paid by the second party to the First Party.
06.   The last limit for to make payment of the Forty Lac Sixteen Thousand taka Bank Chque is February/2008 AD.
07.   In the Agreement Letter of this Contract, the second party Md. Manik's wife Mrs. Gulshan Akhter and son Obaidul Morshed is 2 No. and 3 No. Witness.

08.   Due to absent of the second party, the value of this Flat to make full understand and to get it, the second party and the heir of the second party Mrs. Gulshan Akhter and Obaidul Morshed, there will involved of the responsibility and as per mentioned time in the said Agreement, there would be bound to pay the value of the Flat.
09.   Total value of the Flat 73,57,000/- (Seventy three lac fifty seven thousand), upto the period of get understand of the first party and to give understand of the second party, there will be under the customer of the Flat to the First party and after made of full money, the first party will be transferred of the flat to the second party.
10.   There is attached a 5th account page with this Agreement and there is mentioned in it about dues and pay etc. of both of party. Of which will be treated as the part of the Agreement.
11.   In this Agreement, there is made the No. 1 Witness of Nigar Sultana.

Both of the parties and in presence of the witnesses, after read out of the Agreement and after understand the ground of it, in full of sense were put of signature. In same of the fact, the heirs of the second party were read understand the ground of the agreement and were put signature in the place of the witnesses.
