LETTER OF UNDERTAKING

CONSTRUCTION SDN. BHD. hereby understand
and agreed with the terms and
conditions as stated below:
1.
Job Category: As construction worker.
2.
Contract Period : 3 years
3.
Working Hour:
Daily working
hours is 8 hours per day (basic hours),
6 days per week will calculated as normal rate.
The following next 2 hours (5.00 pm to 7.00 pm) will be canculated as x1.5 or depends on respective job site. 6
working days whereby on the seventh day or any public Holidays will be
calculated as normal working rate.
4.
Off Day/Holiday.
The employee is
entitled for an off day upon approval from Employer or Supervisor only.
5.
Government Levy and Immigration.
The employer
will deduct a sum of RM 124.00 per month from the worker.
6.
If salary is
release later than normal payday due to unforeseen circumstances,
employee will be given advances.
7.
Yearly Medical.
Yearly medical
examination will be arranged as required by the Immigration department of Malaysia and
cost incurred will be borne by employee by deduction of salary.
8.
Air ticket.
Single journey
air ticket back to Bangladesh
would be provided upon completion of the Employment contract.
9.
Restriction.
One.
That the employee shall not marry with any Malaysian
and shall not participate in any political activities of those connected with
Trade Union in Malaysia.
Two.
That the
employee shall not change his employment during the contract period and shall
not carry or do business without the written permission from the employer.
Three.
That if employee
is found creating social problems and or engaged, with immediate effect and
will be repatriated to Bangladesh
on his own expenses.
Four.
That if the
employee is found drinking alcohol/liquor or gambling , he will be terminated
from his employment contracted with immediate effect and will be repatriated to
Bangladesh
on his own expenses.
19) Special
Undertaking of the employee
a) The employee undertake to
acknowledge receipt of the copies of undertaking letter, Company Rules &
Regulations and Hostel Rules & Regulations and are advised to read and
understand fully the contents. For the employees who are illiterate, they must
contract their respective leaders/supervisor/seniors/ and get in explained upon
receipt.
b) The employee
shall indemnify the employer in respect of all liability be it civil or
criminal relating to any loss, damage or injury or consequential or indirect
loss caused by the willful or negligent conducts of the employee due to the
breach of this agreement.
2.) Certification
The employer and
the employee shall read and fully understand this agreement and certify that
the terms and conditions together with the application constitute their entire
agreement or understand that aside from this contract shall be considered null
and void.
